These Terms of Service (“Terms”) govern your access to and use of fragrancepark.com, including purchases and related services provided by FragrancePark Inc. (“FragrancePark,” “we,” “us,” or “our”).

By accessing the website, creating an account or placing an order, you agree to these Terms and the policies referenced in them. If you do not agree, do not use the website.

2. Eligibility and Website Use

You must be at least 18 years old, or the age of legal majority where you reside, to place an order. A parent or legal guardian may use the website on behalf of a minor.

You agree to use the website only for lawful purposes and in accordance with these Terms.

You must not:

Use the website for fraudulent, unlawful or abusive activity
Submit false order, account, payment or contact information
Attempt to gain unauthorized access to accounts, systems or information
Interfere with the operation, security or availability of the website
Introduce malware, malicious code or harmful technology
Use bots, scraping tools or automated systems in a manner that disrupts the website or places an unreasonable burden on its infrastructure
Attempt to evade fraud-prevention, purchase-limit or security controls

We may restrict or terminate access when we reasonably believe a user has violated these Terms, engaged in fraud or threatened the website, our business or other users.

An account is not required for every purchase. If you create an account, you are responsible for:

4. Independent Retailer and Trademark Notice

FragrancePark Inc. is an independent retailer of branded fragrances, beauty products, skincare, haircare and personal-care products.

Unless expressly stated otherwise, FragrancePark is not affiliated with, sponsored by, endorsed by, or an authorized representative of the brands displayed on this website.

Brand names, trademarks, logos and product names belong to their respective owners. They are used on this website solely to identify and accurately describe the branded products offered for sale.

The availability of a branded product on FragrancePark does not mean that the trademark owner supplies FragrancePark directly, sponsors FragrancePark or has approved FragrancePark as an authorized retailer.

5. Product Information

We make reasonable efforts to provide accurate product titles, descriptions, sizes, concentrations, conditions, images and other information.

Product packaging, labels, bottle designs and presentation may change because of manufacturer updates, regional variations, regulatory requirements or production-batch differences. Display settings may also affect how colors and images appear.

The product’s brand, name, size, concentration and disclosed condition should correspond to the item ordered, but packaging may differ from an image when the underlying product has not materially changed.

Product use and safety

Read product labels, ingredients, directions and warnings before use. Product information on our website is provided for general informational purposes and is not medical advice.

Customers with allergies, sensitivities or medical concerns should consult an appropriate healthcare professional before using a product.

6. Pricing, Taxes and Corrections

All prices are displayed in U.S. dollars unless otherwise stated. Applicable U.S. sales tax is calculated during checkout based on the order and shipping destination.

Prices, promotions and availability may change without notice before an order is submitted.

Although we work to maintain accurate information, typographical, pricing, inventory or catalog errors may occur. If an error affects an order, we may contact you for instructions or cancel the affected item and issue an appropriate refund.

We will not charge a corrected higher price without your authorization.

7. Orders and Acceptance

An order confirmation acknowledges that we received your order. It does not mean the order has been finally accepted or shipped.

We may review, hold, limit, refuse or cancel an order for reasons including:

Product unavailability
Pricing or catalog errors
Incomplete or inaccurate customer information
Payment authorization failure
Suspected fraud, unauthorized activity or resale abuse
Shipping restrictions
Violation of these Terms or another applicable policy

If we cancel an order after payment has been authorized or collected, we will void the authorization or issue an appropriate refund to the original payment method. Banks and payment providers may require additional time to release a pending authorization or post a refund.

Products are subject to availability. If an item becomes unavailable after an order is submitted, we may cancel the unavailable item and issue a refund. We will not substitute another product without your agreement.

8. Payments

Available payment methods are displayed during checkout and may include payment cards, digital wallets and third-party payment services.

Payment information is processed by Shopify and supported third-party payment providers. By submitting payment information, you represent that:

The information is accurate and complete
You are authorized to use the selected payment method
You authorize the applicable charges for the order

We may request additional information or verification before accepting or shipping an order. An order may be delayed or canceled if requested verification cannot be completed.

9. Shipping and Delivery

FragrancePark currently ships only to addresses within the United States.

Processing time: Generally 1–2 business days, Monday through Friday
Carrier transit time: Generally 2–5 business days
Estimated total delivery time: Generally 3–7 business days
Orders of $69 or more: Free standard shipping
Orders under $69: $8.95 flat-rate standard shipping
Carriers: USPS, UPS or FedEx

The subtotal used to determine free-shipping eligibility is calculated after discounts and before applicable sales tax.

Shipping and delivery times are estimates and are not guaranteed. Weather, holidays, carrier delays, transportation restrictions, address problems, verification requirements and circumstances outside our reasonable control may affect delivery.

Fragrances, aerosols and other products subject to carrier restrictions may qualify only for ground or other designated transportation services.

Customers are responsible for providing a complete and accurate shipping address. Address changes cannot be guaranteed after processing begins.

Additional terms concerning tracking, returned packages, multiple shipments and delivery issues are contained in our Shipping Policy, which is incorporated into these Terms.

10. Cancellations

We will attempt to accommodate the request, but cancellation or modification cannot be guaranteed after an order has entered processing. An order that has already shipped cannot be canceled.

If an order cannot be canceled, an eligible product may be returned after delivery in accordance with our Return & Refund Policy.

11. Returns and Refunds

Eligible products may be returned within 30 calendar days of delivery, subject to the requirements and exclusions in our Return & Refund Policy.

A return requires prior authorization and must be sent according to the provided return instructions. Do not send a return to an address without receiving return instructions from FragrancePark.

After we receive and inspect an eligible return, an approved refund will be issued to the original payment method within seven business days. The applicable bank or payment provider may require additional time to post the refund.

Customers are generally responsible for return shipping unless the product received was damaged, defective or incorrect.

Our Return & Refund Policy is incorporated into these Terms. If there is a conflict concerning return procedures, the Return & Refund Policy controls.

12. Promotions and Discounts

Promotions, discount codes and special offers may be subject to separate eligibility requirements, exclusions, expiration dates and usage limits.

Unless the promotion states otherwise:

Only one promotional code may be used per order
Promotions cannot be applied retroactively
Promotional value is not redeemable for cash
Some products, brands or categories may be excluded
Discounts may affect free-shipping eligibility

We may cancel or correct a promotion affected by error, fraud, misuse or unauthorized distribution, subject to applicable law.

13. Gift Cards

If FragrancePark offers gift cards, their use is subject to the terms displayed when the gift card is purchased or issued.

Unless otherwise required by law, gift cards:

May be redeemed only through FragrancePark.com
Cannot be exchanged for cash
Should be treated like cash and protected from unauthorized use

Additional restrictions or legally required rights may apply depending on the gift card and the customer’s location.

14. Customer Communications

By placing an order or creating an account, you agree to receive transactional and service-related communications, including:

Order confirmations and status updates
Payment or verification notices
Shipping and delivery notifications
Return and refund communications
Account and security notices

If you separately subscribe to marketing communications, you may unsubscribe using the link in an email or by contacting us. Opting out of marketing does not stop necessary transactional or service messages.

15. Reviews, Feedback and Submissions

If you submit a review, photograph, comment, suggestion or other content, you represent that:

You have the right to submit it
It is truthful and not misleading
It does not violate another person’s privacy, intellectual-property or other rights
It is not unlawful, defamatory, abusive or malicious

You grant FragrancePark a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt and distribute the submitted content in connection with operating and promoting our business, subject to applicable law and our Privacy Policy.

We may remove submitted content that violates these Terms.

16. Intellectual Property

FragrancePark owns or has rights to the website’s original layout, design elements, original written content and FragrancePark branding, subject to third-party rights.

Third-party brand names, trademarks, logos, product photographs and product information belong to their respective owners or applicable rights holders. Nothing in these Terms transfers ownership of third-party intellectual property to FragrancePark.

You may use the website for personal, noncommercial shopping purposes. You may not reproduce, republish, distribute, commercially exploit or create derivative works from protected website content without permission from the applicable rights holder.

Our collection and processing of personal information are described in our Privacy Policy.

The Privacy Policy explains:

Use of the website is also subject to any cookie or privacy choices you make through available website controls.

18. Third-Party Services and Links

The website may use or link to services operated by Shopify, payment providers, shipping carriers, social-media platforms and other third parties.

We do not control third-party websites or services and are not responsible for their availability, content, security or privacy practices. Review the applicable third party’s terms and privacy policy before using its service.

Unless clearly disclosed, a link does not indicate that FragrancePark is affiliated with, sponsored by or endorsed by the third party.

19. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free or free of harmful components.

We make reasonable efforts to describe and supply products accurately. Except for express promises made in our policies and warranties that cannot lawfully be excluded, products are provided subject to the manufacturer’s applicable information, warnings and warranties.

Some jurisdictions do not permit the exclusion of certain warranties. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

20. Limitation of Liability

To the fullest extent permitted by applicable law, FragrancePark Inc. and its officers, employees and agents will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages arising from use of the website or services.

To the fullest extent permitted by applicable law, FragrancePark’s aggregate liability arising from an order or use of the website will not exceed the amount paid for the product or order giving rise to the claim.

These limitations do not apply where prohibited by law and do not exclude liability that cannot legally be limited, including applicable statutory consumer rights.

21. Indemnification

To the fullest extent permitted by law, you agree to indemnify FragrancePark Inc. against third-party claims, losses and reasonable expenses arising from your unlawful use of the website, your violation of these Terms or your infringement of another party’s rights.

This provision does not require you to indemnify FragrancePark for its own unlawful conduct, gross negligence or willful misconduct.

22. Force Majeure

FragrancePark will not be responsible for delay or failure caused by circumstances beyond its reasonable control, including severe weather, natural disasters, public emergencies, labor disruptions, carrier interruptions, supply-chain interruptions, government actions, power failures and technology outages.

We will make reasonable efforts to reduce the effect of such events and communicate significant order delays when practical.

This section does not limit statutory consumer rights that cannot legally be excluded.

23. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer laws apply.

Before initiating formal legal proceedings, customers are encouraged to contact us so we can attempt to resolve the issue directly.

Subject to applicable law, legal proceedings relating to these Terms may be brought in a court with lawful jurisdiction in Westchester County, New York.

Nothing in this section prevents a consumer from bringing a claim in another location when applicable law gives the consumer that right.

24. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

25. No Waiver

If FragrancePark does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

26. Changes to These Terms

We may update these Terms to reflect changes in our business, services, policies or legal obligations.

When changes are made, the “Last updated” date at the top of this page will be revised. Additional notice may be provided when required by law.

Changes will not retroactively reduce rights relating to an order already completed unless permitted by law.
